Distance sales agreement

Article 1 – Parties

The SELLER is a company registered in Switzerland and sells to consumers in Turkey through www.ortevavelia.com. Products ship from Turkey.

BUYER
The person whose name, address, phone and email were provided on www.ortevavelia.com when placing the order.

Article 2 – Subject

The subject of this agreement is to determine the rights and obligations of the parties, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product described below, which the BUYER ordered electronically from the SELLER's website www.ortevavelia.com.

Article 3 – Product, payment and delivery

The type, quantity and colour of the product, its VAT-inclusive price, any campaign discount applied, the payment method and the delivery address are as stated on the order summary and in the order confirmation sent to the BUYER. The product is shipped from Turkey by domestic courier; there are no customs procedures or extra fees. Shipping within Turkey is paid by the SELLER. Payment is made with the method chosen at checkout (cash/card on delivery or online card).

Article 4 – General provisions

4.1. The BUYER confirms having read the Preliminary Information Form on the product's main features, price, payment method and delivery before confirming the order, and having given the necessary electronic confirmation.

4.2. The product is handed to the courier within 1–2 business days of order confirmation and delivered to the address given by the BUYER, in any case within the statutory 30-day period.

4.3. The SELLER must deliver the product intact, complete and in accordance with the order. If supplying the product becomes impossible, the SELLER informs the BUYER and refunds the amount collected within 14 days.

4.4. The BUYER agrees to use the product according to the care instructions on its label and to keep it away from open flames, stoves and heaters.

Article 5 – Right of withdrawal

The BUYER may withdraw from the agreement within 14 days of delivery of the product to them or to a third party they designate, without giving any reason and without penalty. Notice of withdrawal is given in writing to destek@ortevavelia.com. Within 10 days of the notice, the BUYER returns the product free of charge within Turkey using the contracted courier specified by the SELLER. The SELLER refunds the full amount collected, in a manner suited to the BUYER's payment method, within 14 days of receiving the notice of withdrawal.

Article 6 – Exceptions to the right of withdrawal

The right of withdrawal does not apply in the cases listed in Art. 15 of the Distance Contracts Regulation (for example, products prepared to the BUYER's specifications or personal needs). The 14-day right of withdrawal applies to standard ORTEVA VELIA products; the product must be returned unused, unwashed and with its label attached. The BUYER is responsible for any loss of value caused by use.

Article 7 – Defective products

For defective products, the BUYER's elective rights under Art. 11 of Law No. 6502 are reserved.

Article 8 – Disputes

Disputes arising from this agreement are handled by the Consumer Arbitration Committee at the BUYER's place of residence within the monetary limits announced by the Ministry of Trade, and by Consumer Courts above those limits.

Article 9 – Entry into force

This agreement is concluded and enters into force when the BUYER confirms the order electronically. It is sent to the BUYER with the order confirmation and kept by the SELLER.
